{"id":1517,"date":"2015-08-30T11:01:24","date_gmt":"2015-08-30T11:01:24","guid":{"rendered":"http:\/\/decotta.wpengine.com\/?p=1517"},"modified":"2015-09-09T10:54:26","modified_gmt":"2015-09-09T10:54:26","slug":"spaniens-nye-lov-om-realkreditlan-hjaelp-til-boligejere-restance","status":"publish","type":"post","link":"https:\/\/decottalaw.com\/da\/spaniens-nye-lov-om-realkreditlan-hjaelp-til-boligejere-restance\/","title":{"rendered":"Spaniens nye lov om realkreditl\u00e5n \u2013 Hj\u00e6lp til boligejere i restance"},"content":{"rendered":"<p>Spanien er s\u00e6rligt h\u00e5rdt ramt af den \u00f8konomiske krise, og landets efterf\u00f8lgende h\u00f8je arbejdsl\u00f8shed og generelle \u00f8konomiske tr\u00e6ngsel, har f\u00f8rt til et rekordstort antal kreditl\u00e5nsrestancer og uds\u00e6ttelser.<\/p>\n<p>En ny lov 1\/2013 af 14. maj for realkredit-l\u00e5ntagere er beregnet til at afhj\u00e6lpe det stigende behov for hj\u00e6lp til boligejere, som har problemer med afbetaling af deres l\u00e5n, og de som st\u00e5r over for en mulig uds\u00e6ttelse.<\/p>\n<p>Den nye lov er kompliceret, men det er fair at sige, at den er et skridt i den rigtige retning, ift. at afhj\u00e6lpe den nylige tendens til uds\u00e6ttelser, som har f\u00f8rt til tragiske selvmord, og s\u00f8ger at hj\u00e6lpe boligejere med i stedet at finde en l\u00f8sning med deres l\u00e5ngivere, som betyder, at de kan blive i deres hjem.<\/p>\n<p>Den nye lov giver f.eks. mulighed for, med \u00f8jeblikkelig virkning og i op til to \u00e5r, at suspendere uds\u00e6ttelser, i tilf\u00e6lde hvor kreditoren (banken) tildeles skyldnerens bolig.<\/p>\n<p>I realiteten er denne ekstraordin\u00e6re foranstaltning direkte rettet imod boligejere, som er i fare for social eksklusion. For at boligejere skal kunne drage fordel af denne beskyttelsesforanstaltning, skal de opfylde en r\u00e6kke kriterier. F.eks. vil disse l\u00e5ntagere, selv dem med negativ friv\u00e6rdi, stadig skulle afvikle afbetalinger p\u00e5 deres l\u00e5n, med en sats som fasts\u00e6ttes ud fra minimumsrenten.<\/p>\n<p>Endvidere betyder denne reviderede lov at:<\/p>\n<ul>\n<li>Der etableres restriktioner ift. fasts\u00e6ttelse af mora-rentesatser, som ikke m\u00e5 overstige tre gange den lovbestemte rentesats, og udelukkende m\u00e5 tilskrives den udest\u00e5ende kapital. Den forbyder kapitalisering af morarenter.I tilf\u00e6lde af udenretsligt salg af den bel\u00e5nte ejendom, som indg\u00e5s for en notar, skal salget fremg\u00e5 i det officielle tidende, s\u00e5 \u00e6gte tilbudsgivere kan afgive tilbud\n<p>S\u00e5fremt en domstol vurderer, at en l\u00e5ntager behandles uretf\u00e6rdigt af l\u00e5ngiveren, vil retten indkalde begge parter til en h\u00f8ring:<\/p>\n<p>Omkostninger begr\u00e6nses til 5\u00a0% af det skyldige bel\u00f8b<\/p>\n<p>Boligejeren nu ikke h\u00e6fter for mere end 50\u00a0% af restg\u00e6lden<\/p>\n<p>For dem, som \u00f8nsker at afgive bud p\u00e5 en ejendom i restance, reduceres afbetalingen fra 20\u00a0% til 5\u00a0%.<\/p>\n<p>N\u00e5r auktionen er blevet afholdt og godkendt, har den vindende tilbudsgiver 40 dage, til at indbetale resten af prisen (tidligere 20).<\/p>\n<p>S\u00e5fremt der ingen tilbudsgivere er til auktionen, skal mindst 70\u00a0% af hypotekets v\u00e6rdi v\u00e6re d\u00e6kket, n\u00e5r der er tale om en prim\u00e6r bop\u00e6l<\/p>\n<p>Auktionstypen m\u00e5 ikke v\u00e6re mindre end 75\u00a0% af den ansl\u00e5ede v\u00e6rdi, for at kunne indg\u00e5 i vedt\u00e6gterne om realkreditl\u00e5n.<\/p>\n<p>Banken kan overtage til eje, med mindre l\u00e5net er mindst 3 m\u00e5neder bagud<\/li>\n<\/ul>\n<p>Disse foranstaltninger har til hensigt at g\u00f8re det mere fair for boligejere, og g\u00f8re det muligt at komme p\u00e5 fode igen i en krisetid.<\/p>\n<p>De giver ogs\u00e5 boligejere ret til at forhandle med deres bank, for at finde en passende l\u00f8sning vedr\u00f8rende deres realkreditg\u00e6ld.
