{"id":255,"date":"2013-03-21T11:58:29","date_gmt":"2013-03-21T11:58:29","guid":{"rendered":"http:\/\/decotta.wpsine-dev.com\/de-cotta-law-wins-a-case-against-the-andalusian-health-service-for-medical-neglicence-de-cotta-law-g\/"},"modified":"2013-03-21T11:58:29","modified_gmt":"2013-03-21T11:58:29","slug":"de-cotta-law-wins-a-case-against-the-andalusian-health-service-for-medical-neglicence-de-cotta-law-g","status":"publish","type":"post","link":"https:\/\/decottalaw.com\/da\/de-cotta-law-wins-a-case-against-the-andalusian-health-service-for-medical-neglicence-de-cotta-law-g\/","title":{"rendered":"De Cotta Law wins a case against the Andalusian Health Service for medical neglicence &#8211; De Cotta Law gana un caso contra el Servicio Andaluz de Salud por negligencia m\u00e9dica"},"content":{"rendered":"<p>In this case, the<br \/>\npatient was receiving chemotherapy<br \/>\ntreatment after successful oncology surgery. <\/p>\n<p>The chemotherapy drug that was administered intravenously,<br \/>\ncaused serious injuries to the patient\u2019s arm, which have left a chronic condition.<\/p>\n<p>The Court ruled that<br \/>\nwhile it is true the damage caused by<br \/>\nthe drug entering the arm, outside the vein, could be considered an accident, yet<br \/>\nthe subsequent performance of the Andalusian Health Service to treat this accident<br \/>\nwas not correct, and this was the cause of considerable<br \/>\ndamage to the arm and subsequent now on-going chronic condition. <\/p>\n<p>It was ruled that the hospital did not act immediately following the recognition of the medical emergency, and that<br \/>\nthe initial response was poor and<br \/>\nincorrect. <\/p>\n<p>In addition, the patient suffered further delays for<br \/>\nemergency treatment.<\/p>\n<p>In the court proceedings De Cotta Law proved that had the Andalusian Health Service acted with greater diligence when treating these injuries,<br \/>\nthe effects of the accident would have been successfully minimised and the patient would<br \/>\nnot have suffered the consequences of what is now a chronic<br \/>\ncondition.<\/p>\n<p>Andalusian Health Service<br \/>\nwas obliged to compensate the victim<br \/>\nin excess of \u20ac 70,000.<\/p>\n<p>Reyes G\u00f3mez<br \/>\nLlorente<\/p>\n<p>Abogada\n<\/p>\n<p>For more information on Civil Litigation or to discuss a case, please contact De Cotta Law on <a href=\"mailto:injury@decottalaw.net\">injury@decottalaw.net<\/a><\/p>\n<p>En este caso,<br \/>\nla paciente que estaba recibiendo un tratamiento de quimioterapia tras haber<br \/>\nsido operada con \u00e9xito, sufri\u00f3 extravasaci\u00f3n del f\u00e1rmaco que le caus\u00f3 graves<br \/>\nlesiones en su brazo, que le han dejado considerables secuelas. El Juzgado ha<br \/>\nconsiderado que si bien es cierto que la extravasaci\u00f3n del f\u00e1rmaco fuera de la<br \/>\nvena pudo ser un accidente, es cierto que la posterior actuaci\u00f3n del Servicio<br \/>\nAndaluz de Salud (SAS) al tratar el accidente no fue la correcta, y ello fue la causa<br \/>\nde la magnitud de las lesiones. Los servicios m\u00e9dicos no actuaron de inmediato<br \/>\nsiguiendo las actuaciones precisas y necesarias cuando ocurre una emergencia de<br \/>\neste tipo, sino que la primera asistencia prestada fue bastante deficiente e<br \/>\nincorrecta. A ello se une el que la paciente no fue atendida posteriormente con<br \/>\nla urgencia requerida por los especialistas adecuados, sino que tuvo que<br \/>\nsoportar una larga lista de espera.
