{"id":309,"date":"2011-11-02T15:08:51","date_gmt":"2011-11-02T15:08:51","guid":{"rendered":"http:\/\/decotta.wpsine-dev.com\/el-inquilino-moroso-tendra-10-dias-para-evitar-el-desahucio\/"},"modified":"2011-11-02T15:08:51","modified_gmt":"2011-11-02T15:08:51","slug":"el-inquilino-moroso-tendra-10-dias-para-evitar-el-desahucio","status":"publish","type":"post","link":"https:\/\/decottalaw.com\/da\/el-inquilino-moroso-tendra-10-dias-para-evitar-el-desahucio\/","title":{"rendered":"El inquilino moroso tendr\u00e1 10 d\u00edas para evitar el desahucio"},"content":{"rendered":"<p><em>El desahucio de viviendas por impago del inquilino podr\u00e1 acelerarse a partir de este lunes, cuando entra en vigor la Ley de Medidas de Agilizaci\u00f3n Procesal, que permite al propietario acogerse al sistema del proceso monitorio -r\u00e1pido y sencillo- para la reclamaci\u00f3n de las rentas y desahucio.<\/p>\n<p> Esta norma, incluida en el plan de modernizaci\u00f3n de la Justicia del ministro Francisco Caama\u00f1o, acomete reformas destinadas a simplificar los procesos y acortar los tiempos de respuesta de los tribunales, mediante la eliminaci\u00f3n de tr\u00e1mites innecesarios.<\/p>\n<p> Entre otras, modifica la Ley de Enjuiciamiento Civil (LEC) al permitir que, una vez presentada la demanda por impago, el secretario judicial d\u00e9 diez d\u00edas al inquilino para que abone la cantidad adeudada, abandone la vivienda o presente las alegaciones por las que se opone al pago.<\/p>\n<p> Si transcurrido dicho periodo el demandado no ha realizado ninguna de las opciones, el secretario judicial proceder\u00e1 directamente a dar fecha para el lanzamiento (d\u00eda en el que se hace efectivo el desalojo del inmueble), previa solicitud del propietario.<\/p>\n<p> Hasta ahora, tras la demanda por impago el Juzgado se\u00f1alaba la fecha del juicio, en la que se reconoc\u00eda al propietario el derecho a recuperar su vivienda, as\u00ed como la fecha del lanzamiento, lo que alargaba los plazos meses.<\/p>\n<p> Con la reforma actual, el derecho a recuperar la vivienda puede ser reconocido en un plazo de diez d\u00edas.<\/em><\/p>\n<p><em>La reforma ser\u00e1 insuficiente si no va acompa\u00f1ada de la implementaci\u00f3n de personal en los juzgados.<\/p>\n<p> Seg\u00fan explic\u00f3, hasta ahora, el arrendador debe esperar meses para el desalojo, llevado a cabo por una comisi\u00f3n judicial que fija las fechas por riguroso orden de asuntos.<\/p>\n<p> Hacen falta m\u00e1s medios humanos que practiquen los lanzamientos en un &quot;tiempo breve&quot; para que el arrendador no tenga que esperar meses a que el personal del juzgado se desplace a su vivienda, acompa\u00f1ada de la fuerza p\u00fablica, para devolv\u00e9rsela, apunt\u00f3.<\/p>\n<p> Esta modificaci\u00f3n de la LEC viene a completar la llamada Ley de Medidas de Fomento y Agilizaci\u00f3n Procesal del Alquiler y Eficiencia Energ\u00e9tica de los Edificios, denominada &quot;Ley del desahucio expr\u00e9s&quot; que fue aprobada en 2009.<\/p>\n<p> Esta norma redujo de dos meses a uno el plazo que debe transcurrir entre el momento en el que el arrendador exige por requerimiento el pago de las deudas atrasadas y el momento en que puede presentar una demanda. <\/em><\/p>\n<p>&#0160;<\/p>\n<p><strong>New Tenant Eviction Law &#8211; The defaulting tenant has 10 days to avoid eviction<\/strong><\/p>\n<p>The eviction of the tenants has been made easier this week, with the passing of the new Law on Measures to Streamline Eviction Procedures (Ley de Medidas de Agilizaci\u00f3n Procesal). This allows the property owner to claim for lost rental income and evict tenants more swiftly and easily.<\/p>\n<p>This provision, outlined by the Justice Minister Francisco Caamano, reforms and streamlines eviction processes and shortens the response times of the courts, by eliminating some unnecessary procedures.<\/p>\n<p>Among other things, the Law on Civil Procedure (LEC) is amended so that when a legal request has been filed for non-payment, the court offers the tenant ten days to pay the amount due, leave the home or formally contest the request.<\/p>\n<p>If after this period the defendant has not done one of these three things, the court will proceed and issue an eviction date (date on which the eviction becomes effective the property).<\/p>\n<p>Before hand this process would have taken many months if not years.<\/p>\n<p>With the current reform, the process is accelerated to 10 days.<\/p>\n<p>However, the reform will be insufficient if not accompanied by the deployment of more staff in the courts.<\/p>\n<p>He explained that until now, the landlord must wait months for eviction, carried out by a judicial commission.<\/p>\n<p>More human resources are needed if landlords are not to have to wait months for court bailiffs, accompanied by security, to recover property.<\/p>\n<p>This modification of the LEC, called the called &quot;Express Eviction Act\u2019<\/p>\n<p>follows changes detailed in the&#0160; \u2018Ley de Medidas de Fomento y Agilizaci\u00f3n Procesal del Alquiler y Eficiencia Energ\u00e9tica de los Edificios?, (Building Measures Act and Procedural Streamlining and Efficiency Rental of Buildings), which was approved in 2009.<\/p>\n<p>Before this, landlords would have to wait a minimum of two months after non-payment of rent from before being able to seek payment through the courts.
