We are often asked if English law recognises pre marital
\ncontract.  <\/span>English law differs from the
\nrest of Europe as we have a common law system where the
\n\u201cmatrimonial regime<\/o:p> 2 is not a fixed system granting specific rights from the
\nmoment of marriage.<\/o:p><\/p>\n

<\/o:p>In <\/st1:place><\/st1:country-region>Spain for example, the normal or default regime is gananciales or community of
\nproperty.  <\/span>On divorce, this provides for
\nthe equal sharing of these assets that have accrued during the marriage.  <\/span>A couple can elect to maintain separation of
\nassets where each maintains and owns their own property even on divorce.<\/o:p>\n<\/p>\n

<\/o:p>As the English regime is not defines as community of
\nproperty, it is often assumed to be separation assets.  <\/span>This can lead to serious problems when an
\nEnglish couple divorce in <\/st1:place><\/st1:country-region>Spain.<\/p>\n
