This now<br \/>\ncommonly includes automatic debiting of owed taxes and late payment fines<br \/>\ndirect from non-resident bank accounts in Spain.<\/p>\n<p style=\"text-align: center;\">\n<a class=\"asset-img-link\" href=\"http:\/\/decottamckennaysantafe.typepad.com\/.a\/6a010536f0d59b970c019aff50f84a970c-pi\" style=\"display: inline;\"><img decoding=\"async\" alt=\"De Cotta Law Conveyancing\" border=\"0\" class=\"asset  asset-image at-xid-6a010536f0d59b970c019aff50f84a970c image-full\" src=\"http:\/\/decottamckennaysantafe.typepad.com\/.a\/6a010536f0d59b970c019aff50f84a970c-800wi\" title=\"De Cotta Law Conveyancing\" \/><\/a><\/p>\n<p>As<br \/>\na holiday home owner in Spain<br \/>\none is obliged to comply with Spain\u2019s<br \/>\nnon-resident fiscal and tax obligations.<\/p>\n<p>Some<br \/>\nnon resident property owners have been receiving tax notifications and are not<br \/>\naware that their failure to respond can ultimately lead to embargoes on bank<br \/>\naccounts. An embargo is a court approved sanction, allowing private bank<br \/>\naccounts to be automatically debited, or frozen in the event of insufficient<br \/>\nfunds.<\/p>\n<p>This<br \/>\nis because the tax authority is now stepping up its work on recovery of unpaid<br \/>\ntaxes and property ownership carries with it fiscal and tax obligations that<br \/>\nmust not be avoided.<\/p>\n<p>For<br \/>\nthose making their annual tax declaration with a law or accountancy firm your<br \/>\nadviser can provide you with copies of your annual returns if you receive any<br \/>\nnotification from the tax authority or \u2018Hacienda\u2019.<\/p>\n<p>You<br \/>\nwould expect to receive an informative, warning letter first but if you or your<br \/>\nadvisor have not kept your contact address up-to-date following a sale, this<br \/>\ncan lead to delays and a failure to react can lead to problems. <\/p>\n<p>For<br \/>\nexample you may have sold a property and therefore not be paying the annual tax<br \/>\nbut the tax authority might still advise you as they have a record of your<br \/>\nprevious annual payments. Again for most people this just means providing a<br \/>\ncopy of their deed of sale to the tax authority to show that they have no tax<br \/>\nto pay. <\/p>\n<p>Some<br \/>\nproperty owners who purchased in the boom years did not commence annual payment<br \/>\nof the non resident taxes and this can result in fines and embargoes once the<br \/>\nproperty ownership comes to the attention of the tax authorities. The cost of<br \/>\nappointing a professional to do your tax returns and the tax payments<br \/>\nthemselves are considerably less than picking up fines of 3.000\u20ac or more for<br \/>\nunpaid taxes. Even if you have not paid for some years it is still worth making<br \/>\nup the payment for the last 4 years to avoid any embargo on your bank accounts<br \/>\nin future. <\/p>\n<p><strong>Act Now<\/strong><\/p>\n<p>If<br \/>\nyou are not a tax resident of Spain<br \/>\nbut own property here, you must act now, and declare your up-to-date property<br \/>\ninvestments. Action is much easier and cheaper than reaction.<\/p>\n<p>A<br \/>\ncalculation of the tax can be provided quickly and accurately. Each owner is<br \/>\nliable, but a couple would pay less than 175\u20ac including IVA, and more joint<br \/>\nowners receive a discounted rate in fees to make the declaration; so do ask for<br \/>\nadvice on this very important matter.
