clauses \u00ab\u00a0plancher\u00a0\u00bb"},"content":{"rendered":"<p><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"SPANISH MORTGAGE CLAIMS : Following a judgment of the European Court of Justice on 21st December 2016 you may be able to claim compensation from your bank  if you have a mortgage containing a \u201cfloor clause\u201d which has been held to be  unlawful by the European Court of\"><strong>RECLAMATIONS HYPOTH\u00c9CAIRES ESPAGNOLES<\/strong>: \u00e0 la suite d&rsquo;un arr\u00eat de la Cour de justice des Communaut\u00e9s europ\u00e9ennes du 21 d\u00e9cembre 2016, vous pourrez demander une indemnisation aupr\u00e8s de votre banque si vous avez une hypoth\u00e8que contenant une \u00abclause plancher\u00bb jug\u00e9e ill\u00e9gale par ladite Cour europ\u00e9enne<\/span><span title=\"Justice.\n\n\">.<\/p>\n<p><\/span><span title=\"Many Spanish mortgages were linked to a variable interest rate such as the European Borrowing Rate (Euribor).\">De nombreuses hypoth\u00e8ques espagnoles \u00e9taient li\u00e9es \u00e0 un taux d&rsquo;int\u00e9r\u00eat variable tel que le taux d&#8217;emprunt europ\u00e9en (Euribor). <\/span><span title=\"A lot of these mortgages had a floor clause which meant even if (as it did) the official interest rate dropped to a very low level, the customers mortgage was stuck at the floor rate.\">Beaucoup de ces hypoth\u00e8ques avaient une clause \u00ab\u00a0plancher\u00a0\u00bb, ce qui signifiait m\u00eame si le taux d&rsquo;int\u00e9r\u00eat officiel a chut\u00e9 \u00e0 un niveau tr\u00e8s bas (ce qui c&rsquo;est d\u00e9roul\u00e9), l&rsquo;hypoth\u00e8que des clients \u00e9tait bloqu\u00e9e au taux plancher. <\/span><span title=\"This meant people were paying much more than they should have been.\n\n\">Cela signifiait que les gens payaient beaucoup plus qu&rsquo;ils auraient d\u00fb.<\/p>\n<p><\/span><span title=\"Consumers who have one of these mortgages,  can now claim for the wrongly charged interest going back to 2008 or earlier in many cases.\n\">Les consommateurs ayant une de ces hypoth\u00e8ques, peuvent maintenant r\u00e9clamer les int\u00e9r\u00eats ind\u00fbment factur\u00e9s qui remontent \u00e0 2008 ou dans de nombreux cas \u00e0 plus t\u00f4t.<\/span><\/span><\/p>\n<p><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"Consumers who have one of these mortgages,  can now claim for the wrongly charged interest going back to 2008 or earlier in many cases.\n\"><br \/>\n<\/span><span title=\"The losses could be \u20ac200 or more per month on a mortgage of \u20ac150,000 which means that claims could be as high as \u20ac20,000.\n\n\">Les pertes pourraient \u00eatre de 200 \u20ac ou plus par mois sur une hypoth\u00e8que de 150 000 \u20ac, ce qui signifie que les r\u00e9clamations pourraient atteindre 20 000 \u20ac.<\/p>\n<p><\/span><span title=\"On Friday 20th January, the Spanish government published draft legislation by way of a Royal Decree (Real Decreto) known as \u201cRoyal Decree 1\/2017 of 20 January on urgent measures for protection of Consumers in floor clause cases\u201d.\">Vendredi le 20 janvier, le gouvernement espagnol a publi\u00e9 un projet de loi par d\u00e9cret royal (Real Decreto) connu sous le nom de \u00ab\u00a0D\u00e9cret Royal 1\/2017 du 20 janvier sur les mesures urgentes pour la protection des consommateurs dans les cas de clause plancher\u00a0\u00bb. <\/span><span title=\"It sets up a scheme for claiming compensation without the need for litigation.\n\n\">Il met en place un syst\u00e8me de r\u00e9clamation et d&rsquo;indemnisation sans n\u00e9cessit\u00e9 de litige.<\/p>\n<p><\/span><span title=\"This legislation was widely anticipated but was ultimately something of a disappointment from a consumer\u2019s point of view with most of the advantages being in the banks\u2019 favour.\n\n\">Cette l\u00e9gislation \u00e9tait largement anticip\u00e9e, mais a finalement \u00e9t\u00e9 d\u00e9cevante du point de vue du consommateur, la plupart des avantages \u00e9tant en faveur des banques.<\/p>\n<p><\/span><span title=\"The important points are as follows ;\n\n\u00a0\u00a0\u00a0\u00a0\">Les points importants sont les suivants:<\/span><\/span><\/p>\n<ul>\n<li><strong><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"It only applies to consumers - It does not apply to properties owned by companies\n\u00a0\u00a0\u00a0\u00a0\">Elle ne s&rsquo;applique qu&rsquo;aux consommateurs &#8211; Elle ne s&rsquo;applique pas aux propri\u00e9t\u00e9s appartenant \u00e0 des entreprises<\/span><\/span><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"It only applies to consumers - It does not apply to properties owned by companies\n\u00a0\u00a0\u00a0\u00a0\">.<\/span><\/span><span id=\"result_box\" class=\"\" lang=\"fr\"><\/span><\/strong><\/li>\n<li><strong><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"For the consumer, it is voluntary.\">Pour le consommateur, c&rsquo;est volontaire. <\/span><span title=\"The consumer may decide not to apply via the new scheme and can choose to take the case directly to court\n\u00a0\u00a0\u00a0\u00a0\">Le consommateur peut d\u00e9cider de ne pas postuler via le nouveau syst\u00e8me et peut choisir de porter l&rsquo;affaire directement devant les tribunaux.<\/span><\/span><\/strong><\/li>\n<li><strong><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"The consumer may decide not to apply via the new scheme and can choose to take the case directly to court\n\u00a0\u00a0\u00a0\u00a0\">Le r\u00e8glement <\/span><span title=\"It is in force from January 21st 2017\n\u00a0\u00a0\u00a0\u00a0\">est en vigueur \u00e0 partir du 21 janvier 2017.<\/span><\/span><\/strong><\/li>\n<li><strong><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"Banks had a month to establish a complaint system that should be publicised in their branches and on their website.\">Les banques ont eu un mois pour mettre en place un syst\u00e8me de plaintes qui devrait \u00eatre annonc\u00e9 dans leurs succursales et sur leur site Web. <\/span><span title=\"The deadline for banks to establish such a claim system was February 21st 2017. Most banks have now done this.\n\u00a0\u00a0\u00a0\u00a0\">La date limite pour l&rsquo;\u00e9tablissement d&rsquo;un tel syst\u00e8me de r\u00e9clamation \u00e9tait le 21 f\u00e9vrier 2017. <\/span><\/span><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"The deadline for banks to establish such a claim system was February 21st 2017. Most banks have now done this.\n\u00a0\u00a0\u00a0\u00a0\">La plupart des banques l&rsquo;ont fait.<\/span><\/span><\/strong><\/li>\n<li><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"Once the consumer files his claim, the bank has 3 months to settle and pay the due compensation\n\n\"><strong>Une fois que le consommateur d\u00e9pose sa r\u00e9clamation, la banque a trois mois pour r\u00e9gler et payer la compensation due.<\/strong><\/span><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span id=\"result_box\" class=\"\" lang=\"fr\"><span title=\"Therefore if you have a claim for compensation there are the following possibilities:\n\n\">Par cons\u00e9quent, si vous avez une demande d&rsquo;indemnisation, voici les possibilit\u00e9s:<\/p>\n<p><\/span><span title=\"i) A claim is submitted via the scheme and the bank and customer agree on the calculation of compensation and the bank pays this within 3 months of the claim being submitted.\n\n\">i) Une r\u00e9clamation est soumise via le syst\u00e8me et la banque, le client s&rsquo;accordent sur le calcul de l&rsquo;indemnisation et la banque paie dans les 3 mois suivant le d\u00e9p\u00f4t de la demande.<\/p>\n<p><\/span><span title=\"ii) The bank does not respond or make an offer within the required 3 months.\">ii) La banque ne r\u00e9pond pas ou ne fait pas d&rsquo;offre dans les 3 mois requis. <\/span><span title=\"The customer can commence a court action and if he wins, he will be awarded legal costs.\n\n\">Le client peut intenter une action en justice et s&rsquo;il gagne, il se verra attribuer les frais de justice.<\/p>\n<p><\/span><span title=\"iii) An offer is made within the three months but the customer is not satisfied with the calculation.\">iii) Une offre est faite dans les trois mois mais le client n&rsquo;est pas satisfait du calcul. <\/span><span title=\"The customer can commence a court action and if he proves that the bank\u2019s offer was incorrect  he will be awarded the correct level of compensation plus legal costs.\">Le client peut intenter une action en justice et, s&rsquo;il justifie que l&rsquo;offre de la banque est incorrecte, il se verra attribuer le niveau d&rsquo;indemnisation correct, plus les frais juridiques. <\/span><span title=\"If the bank made the correct offer, the customer may be forced to pay the bank\u2019s legal costs in defending the action.\n\n\">Si la banque a fait la bonne offre, le client peut \u00eatre contraint de payer les frais juridiques de la banque pour d\u00e9fendre l&rsquo;action.<\/p>\n<p><\/span><span title=\"iv) The bank and customer agree the level of compensation, but the bank does not pay within the three months : The customer can commence a court action and if he wins , he will be awarded legal costs.\n\n\">iv) La banque et le client acceptent le niveau d&rsquo;indemnisation, mais la banque ne paie pas dans les trois mois: Le client peut intenter une action en justice et s&rsquo;il gagne, il se verra attribuer les frais de justice.<\/p>\n<p><\/span><span title=\"v) The bank rejects the claim: the consumer can commence a court action and if he wins, he will be awarded legal costs.\n\n\">v) La banque rejette la r\u00e9clamation: le consommateur peut intenter une action en justice et s&rsquo;il gagne, il se verra attribuer les frais de justice.<\/p>\n<p><\/span><span title=\"vi) Instead of a cash offer, the bank can offer alternative solutions (reduction of capital of the mortgage, or other financial products), but the customer can refuse this and insist on cash compensation.\n\n\">vi) Au lieu d&rsquo;une offre en esp\u00e8ces, la banque peut proposer des solutions alternatives (r\u00e9duction du capital de l&rsquo;hypoth\u00e8que, ou d&rsquo;autres produits financiers), mais le client peut refuser cela et insister sur une indemnisation en esp\u00e8ces.<\/p>\n<p><\/span><span title=\"Many Spanish tax residents claim tax relief on their mortgage payments.\">De nombreux r\u00e9sidents fiscaux espagnols demandent un all\u00e9gement fiscal sur leurs paiements hypoth\u00e9caires. <\/span><span title=\"If they receive a refund on the interest paid they have to return the tax relief that they received on this original higher level of interest.\n\n\">S&rsquo;ils re\u00e7oivent un remboursement sur les int\u00e9r\u00eats pay\u00e9s, ils doivent rembourser l&rsquo;all\u00e9gement fiscal qu&rsquo;ils ont re\u00e7u \u00e0 ce niveau d&rsquo;int\u00e9r\u00eat initial plus \u00e9lev\u00e9.<\/p>\n<p><\/span><span title=\"On the face of it, it appears that the scheme would be beneficial to the consumer.\">\u00c0 premi\u00e8re vue, il semble que le r\u00e9gime serait b\u00e9n\u00e9fique pour le consommateur. <\/span><span title=\"However, on a deeper analysis it appears that some consumers may still have to take the banks to court to get compensation.\">Cependant, selon une analyse plus approfondie, il semble que certains consommateurs essentially a voluntary code, and what action the Spanish government and\/or the Bank of Spain will take if they don\u2019t.\n\n\">Le temps nous dira si les banques se conforment \u00e0 ce qui est essentiellement un code volontaire, et quelles mesures le gouvernement espagnol et \/ ou la Banque d&rsquo;Espagne prendront si elles ne le font pas.<\/p>\n<p><\/span><span title=\"You will need a copy of your mortgage deed (escritura de prestamo\/hipoteca) , if you don\u2019t have this you can obtain a copy from your bank or from the notary where the deed was signed.\n\n\">Vous aurez besoin d&rsquo;une copie de votre acte d&rsquo;hypoth\u00e8que (escritura de prestamo \/ hipoteca), si vous ne l&rsquo;avez pas, vous pouvez obtenir une copie de votre banque ou du notaire o\u00f9
