{"id":4025,"date":"2020-03-23T10:18:46","date_gmt":"2020-03-23T10:18:46","guid":{"rendered":"http:\/\/decottalaw.com\/?p=4025"},"modified":"2020-03-23T10:18:48","modified_gmt":"2020-03-23T10:18:48","slug":"recommendations-on-child-custody-and-visits-during-the-state-of-emergency-in-spain","status":"publish","type":"post","link":"https:\/\/decottalaw.com\/fr\/recommendations-on-child-custody-and-visits-during-the-state-of-emergency-in-spain\/","title":{"rendered":"Recommendations on child custody and visits during the state of emergency in Spain"},"content":{"rendered":"\n<p>Following\nRoyal Decree 463\/2020, which declared the state of emergency in Spain, please\nsee below some recommendations on child\u2019s guardianship, custody and visits in case\nof divorce and parent-child relations:<\/p>\n\n\n\n<p>1.-\nParents must comply with the sanitary measures and always look for the minor\u2019s\nbest interest.<\/p>\n\n\n\n<p>2.-\nAccording to article 7 of the Decree regarding exceptions to mobility measures,\nCourt orders or mutual agreements about delivery of the minor to the custodial\ndomicile and stay with the non-custodial parent must be complied with, provided\nthat the minor is not placed at risk. The authorities recommend that the\nparents agree the most beneficial accommodation for their children, such\nagreements must be made in writing or by the parents&rsquo; Lawyers.<\/p>\n\n\n\n<p>3.- If\nparents do not reach an agreement, and only one parent has the custody of the\nchild, the recommendation is that the child stays with the custodial parent\navoiding minors\u2019 displacements and risks of contagion, the custodial parent\nwill have to provide daily contact with the non custodial parent.<\/p>\n\n\n\n<p>4.- If\nthe state of emergency lasts more than two weeks, it is possible to agree the\naccumulation of the days that the non custodial parent can visit the child in\norder for the non custodial parent to enjoy these days in a continuous way once\nthe state of emergency ends.<\/p>\n\n\n\n<p>5.- The\ncurrent situation does not suspend any financial or maintenance obligations\ntowards children.
