We are
\noften asked whether a couple can choose which country to divorce in and where
\nthey will have the greater economic advantage. With the new European
\nregulations a \u201cfirst come, first served\u201d approach has been taken. <\/p>\n

\n\"De<\/a><\/p>\n

A lot has
\nbeen written in the news about wealthy individuals – forum shopping<\/em> \u2013 that is looking for the best country to take the
\naction. Where there is considerable wealth this is often thought to be England. One
\nsuccessful London
\ncase went to the Supreme Court and involved a wealthy individual who used a
\nnetwork of companies to try and avoid a payment to his wife. The Supreme Court
\ndecided in favour of the wife in this case. <\/p>\n

However a
\nvery different case will have set alarm bells ringing among English divorce
\nlawyers as a husband\u2019s declared dislike of the English weather has prevented
\nhis wife from making claims against property he has in England! The husband says he
\nintends to remain in Spain although
\nhis wife presented evidence that he was less than complimentary about Spain when they
\nwere together. <\/p>\n

If there is
\na divorce in Spain the door
\ncan remain open in England
\nunder specific provisions which allow someone to make a financial application
\nin England
\nafter a foreign divorce. You have to prove that the financial matters have not
\nbeen properly dealt with and there are assets in England such as property, monies or
\npensions. <\/p>\n

One option
\nis to instruct a barrister in England
\nwho can advise you and act for you. Barristers will be familiar with the
\ndecisions being made in the Family courts so can help in avoiding unnecessary
\nexpense by seeking a negotiated agreement if that is in your best interests. <\/p>\n

They can
\nalso help to ensure that you get disclosure of the true financial situation of
\nthe other party. This can be very important in pension cases for UK spouses. Using
\nthe relatively new Barrister\u2019s Public Access scheme and with the help of an
\ninstructing firm, such as De Cotta Law, based in Spain you can avoid the
\npotentially higher cost of using a UK solicitor\u2019s firm and would only need to
\ntravel to the UK when a court hearing is required. <\/p>\n
