Quando il coniuge o un familiare muore senza aver firmato un\ntestamento in Spagna o nel paese di residenza, la procedura di successione in\nSpagna pu\u00f2 essere molto costosa, lunga e complicata. In Italia la procedura \u00e8\npi\u00f9 semplice ed \u00e8 possibile firmare autocertificazioni ed una dichiarazione\nsostitutiva dell\u2019atto di notoriet\u00e0, ma le formalit\u00e0 sono molto pi\u00f9 rigorose e\ndiverse in Spagna, ed \u00e8 sempre necessario seguire un procedimento per dimostrare\nchi sono gli eredi presentando una serie di documenti italiani e spagnoli. <\/p>\n\n\n\n

Il Regolamento Europeo 650\/2012 stabilisce che alla\nsuccessione si applica la legge dell\u2019ultimo paese di residenza del defunto\nsalvo che nel testamento il testatore scelga la legge della propia nazionalit\u00e0,\nper cui in caso non esista un testamento valido gli eredi dovranno innanzitutto\nprovare che legge deve essere applicata alla successione e poi che hanno diritto\nad ereditare i beni spagnoli del defunto. <\/p>\n\n\n\n

Tutti i documenti italiani che si\npresenteranno a tale effetto dovranno essere tradotti da un traduttore\nufficiale e, salvo rare eccezioni, legalizzati con l\u2019Apostille, per cui\nl\u2019esistenza di un testamento spagnolo semplificher\u00e0 notevolmente la pratica di\nsuccessione e ne ridurr\u00e0 i tempi ed i costi, oltre a garantire l\u2019applicazione\ndella legge italiana alla successione. <\/p>\n\n\n\n
