{"id":391,"date":"2009-02-06T13:30:39","date_gmt":"2009-02-06T13:30:39","guid":{"rendered":"http:\/\/decotta.wpsine-dev.com\/building-in-the-spanish-countryside\/"},"modified":"2014-05-07T11:13:28","modified_gmt":"2014-05-07T11:13:28","slug":"building-in-the-spanish-countryside","status":"publish","type":"post","link":"https:\/\/decottalaw.com\/it\/building-in-the-spanish-countryside\/","title":{"rendered":"Building In The Spanish Countryside"},"content":{"rendered":"<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"EN-GB\">How many times have we asked ourselves the<br \/>\nfollowing question: If I own some land in the countryside, why am I not allowed<br \/>\nto build what I choose on this land?<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"EN-GB\"><o:p>&#0160;<\/o:p>The explanation to this question is provided<br \/>\nfor in the <em>Legislation de la Comunidad<br \/>\nAut\u00f3noma de Andaluc\u00eda. <\/em>This helps detail what is possible when it comes to building in the Spanish countryside (building in the Spanish campo). <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"EN-GB\"><o:p><\/o:p>Fundamentally, the object of this legislation<br \/>\nis to ensure the continued sustainable and united development of urban areas which<br \/>\nare socially economic, cultural and already have basic facilities like roads,<br \/>\nwater and electricity in place, and to protect the areas of countryside to guarantee<br \/>\na better way of life in Andalusia. The <em>Comunidad<br \/>\nAut\u00f3noma de Andaluc\u00eda<\/em> wants to avoid the growth of widely-dispersed<br \/>\nproperties in the countryside where basic services like roads, water and<br \/>\nelectricity are not available, and where the cost of installing these services<br \/>\nis too great. Obviously it is more practical to improve upon or maintain services<br \/>\nwithin an already established urban area.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"EN-GB\"><o:p><\/o:p>Consequently, this limits the type of construction<br \/>\npermitted in non urban areas (known locally as the \u201ccampo\u201d). Principally, this<br \/>\ntype of land is limited to agricultural use, the keeping of livestock, forestation,<br \/>\nand for the use of hunting. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"EN-GB\"><o:p><\/o:p>Subsequently any construction of property must<br \/>\nbe linked to the above-mentioned uses and prior to carrying out any form of<br \/>\nconstruction (ie barns, stables, storehouses) the appropriate licences or<br \/>\nauthorisations must be obtained from the relevant authorities. In order to be<br \/>\ngranted authorisation you must validate the necessary use\/construction.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"EN-GB\"><o:p><\/o:p>On these non-urban areas, land cannot be<br \/>\nsegregated unless it is to be designated for agricultural use, the keeping of<br \/>\nlivestock, forestation, hunting, or that which fulfils the current law\u2019s<br \/>\nlimitations.<span>&#0160; <\/span>These limitations can vary<br \/>\ndepending on the type of land, whether it will be irrigated or not, or it can<br \/>\ndepend on the local area where the land is situated.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"EN-GB\"><o:p><\/o:p>In addition to the above, the law allows a main<br \/>\nfarmhouse or family dwelling to be constructed in these areas. However in order<br \/>\nto construct such a dwelling, it must fall within the following stipulations:<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-GB\"><span>&#8211;<span style=\"font-family: &quot;Times New Roman&quot;; font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal;\">&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;<br \/>\n<\/span><\/span><\/span><span lang=\"EN-GB\">The<br \/>\nland on which it is built must be used for agricultural use, forestation or for<br \/>\nthe keeping of livestock. You are required to prepare a \u201c<em>Proyecto de Actuaci\u00f3n<\/em>\u201d validating said use and proving that you<br \/>\nhave sufficient land required to undertake such activity. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-GB\"><span>&#8211;<span style=\"font-family: &quot;Times New Roman&quot;; font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal;\">&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;<br \/>\n<\/span><\/span><\/span><span lang=\"EN-GB\">There<br \/>\nwill be a maximum build size within which the property must remain. You would<br \/>\nnot be permitted to build a property to any size or height that you desire.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-GB\"><span>&#8211;<span style=\"font-family: &quot;Times New Roman&quot;; font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal;\">&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;&#0160;<br \/>\n<\/span><\/span><\/span><span lang=\"EN-GB\">You<br \/>\nmust also prove that your profession will be in association with one of the<br \/>\nabove activities, ie that you are a farmer and that you will be able to run and<br \/>\nmaintain such a profession.
