During the last 20 years a growing number of English families
\nhave settled in <\/st1:place><\/st1:country-region>Spain.
\n <\/span>Many 
\n<\/span>children are bilingual having settled into Spanish or international
\nschools.  <\/span>If the parents separate,
\nwhether married or not, there can be very difficult decisions about custody,
\nvisits and maintenance.<\/o:p>\n<\/p>\n

<\/o:p>In the most difficult situations, one parent may want to
\nreturn to the <\/st1:country-region>United Kingdom with the children and issues of custody, abduction and consent will need to be
\ndealt with.<\/o:p>\n<\/p>\n

<\/o:p>If a child is taken from <\/st1:place><\/st1:country-region>Spain without the consent of both parents, the Hague Convention provides for the child
\nto be returned to Spain if it is their \u201ccountry of habitual residence\u201d. 
\n<\/span>The Spanish Court will then be the appropriate Court to decide the matter based on the best
\ninterests of the child.<\/o:p>\n<\/p>\n

 <\/o:p>A recent case has shown that a family can have 2 different
\nplaces of habitual residence but it is most likely to be where the children go
\nto school, have their friends and have their family home.<\/o:p><\/p>\n

<\/o:p>It is clearly better for the parents to seek advice and come
\nto an agreement before this happens. 
\n<\/span>Leaving <\/st1:place><\/st1:country-region>Spain and taking the child to the United Kingdom without the consent of the other parent can result in lengthy and stressful legal
\nproceedings in both countries.<\/o:p><\/p>\n

<\/o:p>Maintenance for children is also an important issue.  <\/span>Both parents want to provide for the children
\nbut sometime the disparity in earnings makes it difficult to come to an agreed
\nfigure.  <\/span>It is often better to try and
\nnegotiate a figure rather than have the Court decide the sum but both parents
\nhave a duty to disclose their earnings.<\/o:p><\/p>\n

<\/o:p>In <\/st1:place><\/st1:country-region>Spain an unmarried father or mother will also have the right to apply under the Hague
\nConvention if they have been exercising regular contact with the child.<\/p>\n
