CASE STUDY &#8211; UK Claimant seriously injured in an accident at a hotel while on holiday in Spain"},"content":{"rendered":"<p>De Cotta Law has a highly effective Personal Injury division, providing legal services not only to foriegn residents, tourists and visitors to Spain, but also professional services to international law firms including UK solicitors.<\/p>\n<p>Here we publish an interesting case study from <a href=\"http:\/\/www.stewartslaw.com\/\" target=\"_blank\" title=\"Stewarts Law - UK Personal Injury firm\"><strong>Stewarts Law<\/strong><\/a>, considered one of the UK&#39;s largest litigation only law firms, which specialises in high value and complex disputes.<\/p>\n<p>This case study is about a UK Claimant who was sadly seriously<br \/>\ninjured in an accident at a hotel while on holiday in Spain.<\/p>\n<p style=\"text-align: center;\">\n<a class=\"asset-img-link\" href=\"http:\/\/decottamckennaysantafe.typepad.com\/.a\/6a010536f0d59b970c019b0063fdea970c-pi\" style=\"display: inline;\"><img decoding=\"async\" alt=\"DE COTTA LAW PERSONAL INJURY LAWYERS\" border=\"0\" class=\"asset  asset-image at-xid-6a010536f0d59b970c019b0063fdea970c image-full\" src=\"http:\/\/decottamckennaysantafe.typepad.com\/.a\/6a010536f0d59b970c019b0063fdea970c-800wi\" title=\"DE COTTA LAW PERSONAL INJURY LAWYERS\" \/><\/a><\/p>\n<p><strong><em>Hoteles Pinero<br \/>\nCanarias SL v Keefe<\/em> (2013) \u2013 direct claims against<br \/>\nforeign insurers and joining the policyholder to proceedings before the English<br \/>\nCourts.<\/strong><\/p>\n<p><strong>&#0160;<\/strong><strong><\/strong>In the recent case<br \/>\nof <em>Hoteles Pinero Canarias SL v Keefe<\/em><br \/>\nthe High Court held that the Claimant was entitled to add the Spanish domiciled<br \/>\nHotel as a party to the proceedings before the English Court under Article 11<br \/>\nof Regulation 44\/2011.&#0160; The decision illustrates<br \/>\nhow this provision can be used to ensure Claimants receive full compensation as<br \/>\na result of the tort which forms the subject of their claim. <\/p>\n<p>The Claimant in <em>Keefe <\/em>was seriously injured in an<br \/>\naccident at a hotel while on holiday in Spain.&#0160;<br \/>\nProceedings were issued against the Hotel\u2019s insurer in England, a<br \/>\nprocedural step which has been possible since the ECJ\u2019s decision in <em>Odenbreit<a href=\"#_ftn1\"><strong>[1]<\/strong><\/a><\/em>.&#0160; In <em>Odenbreit<\/em><br \/>\nthe ECJ interpreted Articles 9 and 11 of the Regulation as permitting a<br \/>\nClaimant to bring proceedings in their home Court directly against a foreign<br \/>\ninsurer provided such a direct right of action exists under the applicable law<a href=\"#_ftn2\">[2]<\/a>.&#0160; This decision had the potential to benefit UK<br \/>\nresidents injured abroad enormously by allowing them to pursue Defendants based<br \/>\noverseas in their home Courts where the procedures tend to be more favourable<br \/>\nand accessible.&#0160; <\/p>\n<p>Due to concerns<br \/>\nover the extent of insurance coverage in <em>Keefe<\/em>,<br \/>\nin reliance on Article 11(3), the Claimant applied to join the Hotel to the<br \/>\nproceedings against the insurer.&#0160; Article<br \/>\n11(3) states that if the law governing the direct right of action allows the policyholder<br \/>\nor the insured to be joined as a party to the proceedings then the [foreign]<br \/>\nCourt shall have jurisdiction over them.&#0160;<br \/>\nThe Hotel appealed against the decision giving the Claimant permission to<br \/>\nadd them to the English proceedings.<\/p>\n<p>Dismissing the Hotel\u2019s<br \/>\nappeal in the High Court, Judge Higgins decided that the proper administration<br \/>\nof justice made it essential for a Claimant to be able to pursue the Hotel and<br \/>\nits insurer in the same proceedings.&#0160; The<br \/>\nrelevant insurance policy had not been disclosed which meant there was a<br \/>\nquestion of insurance which needed to be determined as part of the ongoing<br \/>\nproceedings.&#0160; To allow a separate claim<br \/>\nto proceed against the Hotel in the Spanish Courts would give rise to the stark<br \/>\nrisk of irreconcilable judgments. &#0160;<\/p>\n<p>The Hotel argued<br \/>\nthat there was no viable claim outstanding against its insurer because they had<br \/>\nagreed to indemnify but the judge dismissed this argument noting that causation<br \/>\nand quantum were still to be resolved and that the risk of the Claimant being<br \/>\ndenied full compensation justified the Hotel\u2019s joinder to proceedings.&#0160; The claim against the Hotel could not be<br \/>\ncharacterised as one for uninsured loss; this formed part and parcel of the<br \/>\noriginal claim in tort and to find otherwise would potentially leave the Claimant<br \/>\nwithout full compensation.&#0160; The European<br \/>\nRegulations formed part of Spanish law and the accident took place in a resort<br \/>\npopular with holidaymakers from other European countries; it was not<br \/>\nunreasonable for the Hotel to face legal action in the Courts of another Member<br \/>\nState.&#0160; <\/p>\n<p>In <em>Keefe<\/em> the Claimant wanted to join the<br \/>\nHotel to proceedings because there was a risk that the limit of coverage under<br \/>\nthe relevant policy of insurance was not sufficient to provide full<br \/>\ncompensation.&#0160; One could also envisage a<br \/>\nsituation where the insurer is insolvent or the policy of insurance is void for<br \/>\nsome other reason.&#0160; Those too would give<br \/>\nthe Claimant good reason to want to pursue the policyholder directly as an<br \/>\nalternative to the insurer.&#0160; <\/p>\n<p>This decision is helpful<br \/>\nto Claimants who suffer serious injuries while abroad and reflects the purpose<br \/>\nof the European Regulations acting to protect the weaker party and ensure that<br \/>\nthey can bring proceedings against a foreign defendant in their home<br \/>\nCourt.&#0160; If there are question marks over<br \/>\nthe extent of the insurer\u2019s obligations under the relevant policy of insurance<br \/>\nthat require the Claimant to join the policyholder to proceedings then,<br \/>\nprovided the applicable law permits a direct right of action, Article 11(3)<br \/>\ncomes to the injured Claimant\u2019s rescue.&#0160;<br \/>\nThey can then join the insured to proceedings in circumstances where<br \/>\notherwise the Claimant might have been forced to pursue them in a foreign<br \/>\nCourt.&#0160;
