A recent Supreme Court decision has reinforced the ruling
made earlier this year that a purchaser has the right to withdraw from a
contract with a developer if the developer fails to provide a First Occupation
/ Opening Licence (called a ‘Licencia de primera occupación’ in Spanish’
for their Spanish property.
Each case will depend on the particular circumstances but if
the licence is not provided it is best to seek independent legal advice from a
Spanish lawyer who specialises in litigation and property.
