Holiday rentals – New law Update

We can now provide an update on the new law on holiday rentals in Andalucia. This will apply to all individual Urban rental properties and not solely to those owners who have three or more properties. The law will come into effect on 12th May 2016. There will be a grace period of one year before inspections commence and sanctions can be imposed on those who have not fulfilled the requirements.

The aim is to improve the quality of service in the holiday and rental market with minimum standards for accommodation. Each property owner will have to register their property with the tourist department of the Junta de Andalucía. This will be an online registration and a number will be issued to each owner. This number will have to be displayed when advertising and taking bookings.

The law applies to properties in residential areas which are offered to tourists for rental and where the whole property comprises up to 15 places or beds. For example a holiday villa with 1 double room would have to be registered.  If you live in part of the property and part is rented out and there are up to 6 beds or 3 doubles in a B&B you will have to register.

There is also older legislation in place covering the holiday rental of rural and multiple properties and there is a list of requirements including licences or an AFO which is registration of a property that is not within the rural planning rules for the area. At the moment there is still some uncertainty with local Town Halls and the issue of licences for urban and rental properties but we are in contact with the department of the Junta de Andalucia to make sure we can provide the latest information.

We understand that some of the most popular renting websites are insisting on the registration before continuing to advertise.

Once the registration procedure has been clarified by the Junta we will be able to assist you with registering at the Tourist registry of Andalucía. There will be a Declaration for the owner to complete identifying the property, the catastral reference and the licence of occupation or similar and the identity of any company or individual who is carrying out the business on behalf of the owner. Once the registration number has been received this must be included in the publicity and contract.
